Article 61. Only the following shall be commutable in law: 1) Imprisonment, at the rate of five Lempiras (L. 5.00 ) per day; and, 2) Imprisonment for up to five (5) years, at the rate of ten Lempiras (L.10.00) per day. The switches will be paid in cash in the General Treasury of the Republic or in the Institution of the National Financial System that the Secretary of State in the Office of Finance, has authorized for this purpose. If the accused or convicted person lacks the financial means to commute the prison or detention, it shall be commuted to work in favour of the community. The conditions and deadlines shall be fixed in the same terms established in Article 53 of this Code. The provisions of this article shall not apply to anyone who has previously been convicted of an intentional offence; when a special law so provides, or when the special conditions of the convicted person, the motives of his conduct and the circumstances of the act have been assessed, in the opinion of the Judge, its non-origin is established in a reasoned manner
